ill try to make it short.i recently had a car accident and now being without a car a friend recommended me to a guy who buys and sells cars in installments.
we agreed upon me buying a car from him for 3500 if i pay a 500 dollar deposit and 70 dollars a fortnight until the full amount was paid. he also told me if i had and problems with the car to take it to him for repairs he will do the work for free and put the cost of parts on the remaining cost of the car.
so i paid my deposit and my first installment and he transferred the car to me. i then found out that he wrote the cost of the car as 500 on the transfer papers to save money which is fraud.
a couple of days after i picked it up it began stalling for no reason and wouldn't start until it was cooled i was going to have it looked over then 1 night just 4 weeks after picking up the car i was driving home along the highway the car stalled and would not start.
the next day i towed the car to him to take a look at it when i finally got hold of him he told me my timing belt had broken and he would fix it first thing in the morning. unfortunately he did not fix it and it is now 6 weeks later i am still without a car and have continued making payments regularly. until this week i went to see him at his garage only to find his colleges who told me he has not even so much as looked at my car since it has been there. so i decided to stop making payment until the car has been repaired as i should not be paying for a product i am not in possession of. i am now receiving messages saying that i will not receive my car back until my payments are up to date. so my question is as he has put the cost of the car as 500 dollars and i have receipts worth almost 1000 buy law could i claim ownership of the car and if not do i stand a chance in court or would it be more hassle than its worth?|||Possibly, BUT you failed to call him on the fraud, which makes you an accessory, AND he currently has possession and can "claim" additional costs for "repair."
Sounds like your "friend" steered you to a rip off artist.
A few friends like that and you don't need enemies!
