Can a ccj be taken out?

i am really confused and some people on here don't seem to understand my problem and are mouthing off where there unhelpful comments so if i can help its much appreciated. so the problem, after my first year of university me and couple of friends found a house, paid a deposit had copies of id taken apart from one housemate that didnt bother but was still aloud to move in. The contract was not written up by the time summer came so we all went home and hassled the landlord for it over summer. One housemate signed the contract and hes not the type of person to confront anybody if mistakes are there so he signed contract agreeing to pay more rent for a longer period of time that what the house was needed there for. Past three months i had personal troubles and problems with student loans and was unable to keep up with bills and rent etc, so i decided to pay my friends for bills and deal with the rent problem as i came. Another housemate had the same problem and packed up and moved out. My landlord kicked me out as he had every right to and i went without a fuss and recently he has said hes sending bailiffs to my parents house and taking me to court etc if rent was not paid which is understandable. I ve said i actually cant pay any money as i don't have it the best i can do is give it in installments over the summer period whilst i work, not good enough for him and he is persistent on taking me to court, am not trying to scam my way out of this as i have very important friendships i dont want to ruin so i am defiantly going to pay the money as i dont want it falling on my friend who signed the contract to live there. I just want to know from this situation can the landlord take this type of action when ive done all i can to set arrangements for when i pay the rent owed to him. Ive had back things such as yes he can face your responsibilities and most people have said it wont fall to me as i haven't signed a contract to live there, and even if i did come to that where am not liable i will still be paying the rent as i dont want to lose my friends over this can someone please give me some useful adive please thank you!|||To make a long story short:





Yes, he can take you to court. That does not mean he automatically wins.


Whether or not you owe anything still is up to the judge to decide and of course it depends on whether or not you actually show up in court and can produce any paperwork that shows you were not the person that signed the lease.





Only problem is... that if you show up in court with this long winded, strange and silly story the judge will not be sympathetic since you are wearing down his patience and he will lose his temper.





Get yourself a good lawyer and let that lawyer handle everything on your court date. You just show up and be quiet. Trust me... it is in your own favor.|||Yes, the landlord can sue you

I cannot pay this month's rent of 700 and I am moving out the end of the month which is the 30th,my lease ends this month.I have a security deposit of 320 but they will be keeping it for cleaning expenses,and I will not be getting any of it back.The apartment is too expensive for me,and I have struggled for my whole 6 month lease to pay.I had signed the lease a month before I had an accident and injured my leg and back.At the time I was set to move into a one bedroom apartment for 540 a month,but what happened was that it was an upper level unit and I was bedridden after my accident and completely unable to walk up steps,there was no other one bedrooms available with my leasing property on the first floor,so they agreed to transfer my lease to a 2 bedroom lower but it was 700 a month.I havent been able to work,and due to the extent of my injuries im permantly disabled,and i am still in the proccess of getting on disability,but dont have it yet,i have also been put on a waiting list for housing.I have just put down a deposit on a cheaper apartment,and I am set to move on the 30th,but I am broke and unable to pay for this months rent.I only have a few hundred dollars which I will have to give to the moving company to move my stuff out.I have no friends or family willing to lend me any money.And I am on my own,my father co-signed for my lease and I am worried that not paying might mess up his credit.What are the consequences of not paying?Can I offer to pay the remainder of my rent in installments?Next month I will not be able to afford my new rent plus my back rent to the place I am in currently.What can they do to me if I do not pay?Will I be forced out earlier then the 30th?I dont have anywhere to go?what should I do?|||You will be sued and the court costs added to back rent plus penalties, your credit destroyed and an eviction on your record.|||You shouldn't be evicted before the end of the month but the landlord will probably take you to court for the back rent and any damages.|||You are trying harder than most people to do the right thing. In my area there are organizations that offer TRA (Temporary Rent Assistance) to deserving needy persons. Maybe there is something like that where(ever) you are. Check around for legal help organizations. Perhaps a law firm can refer you to a source of pro-bono assistance.|||If i understand you , you are saying your lease is up at the end of the month, but you cannot come up with the rent. Is that correct?. You also say that the landlord has a security deposit from you of $320, so in reality you will owe him $380.When you move out be up front with him, tell him you are broke and that it is a waste of time going after your dad for the money and ask if he will accept a payment plan from you. Make it so that you can pay it and I am sure if you put your case to him nicely, he will take the deal. Dont give him a "take it or leave it" deal because that might just make him mad enough to go after you through the courts. Tell him that the reason you are moving is because you just cant pay the rent any more and that you are leaving before you really get in debt to him. That should sweeten him. Good Luck

Edge models! Cab anyone help me out here?

Ive recently been accepted to edge models and I spoke to Julian today from the agency who told me I can only get my professional portfolio done with one of their approved studios. He said he was going to book me in for the 24th and that the agency will pay for the studio time and the airbrushing etc. But that I would need to put down a deposit of 拢50 via online banking (he gave me the companies bank details to do so) and he said the 拢50 would be given back to me upon arriving at the studio. This sounds fine to me but he then went on to say that I would have to pay 拢300 for copyright of my images and that I could pay it in monthly installments.


I just want to male sure I'm not being scammed cos I have been before by models direct when I was 15.


If you have experienced this, please let me know how it turned out! Thank you in advance


Anna :)|||I don't know that agency, but it is NOT at all normal for a model to pay for copyright. It's completely unneccessary and not at all standard procedure. The copyright stays with the photographer - there is no need to pay for a copyright unless YOU plan to sell your images to a third party. If they are being used in your portfolio, zed card, agency website, your own website or any other non-commercial use, then you don't need the copyright for any reason. You certainly don't need it at the beginning. If at some point in the future you decided you wanted to sell your photos, then you would contact the photographer to transfer the copyright to you in exchange for payment. But not until then. There is no other reason why you would need to hold the copyright





And while agencies may have preferred photographers they like to work with, you should have been given a list of at least 5 different studios to contact on your own, negotiate a price, and pay the photographer directly. And if you have another photographer you want to use, your agency should allow you to after reviewing the photographer's work and confirming they have experience in portfolio shoots|||First things first - NO real agency EVER charges you for a portfolio, or sends you to someone who will charge you for a portfolio (or for anything else - lessons, listing fees, anthing). obviously I dont live in England, as you are quoting in pounds, but here in australia we have a place you can call called the Fair Trading Union, and they have information on every business out there. If this Modelling Agency is legit then you probably have nothing to worry about, if it isnt then its best to check somewhere first..


I do know that it does cost alot of money to have your own portfolio done, and yes, they do prefer their own photographers, but this is the price you pay if you want to be famous or just get by.. See if there is somewhere like the Fair Trading Union of AUst in ENgland.. Hope this helps.

Who gets the apartment?!?

Okay so me and my boyfriend have been dating for almost three years, been living together for two. I haven't brought up breaking up with him yet. But I need help, please! Our lease is not up til February. He was the one who found the place on craigslist, I had the money to move in: $500 deposit and $1,090 for the first and last month's rent. This first 6 months I've been mostly paying for everything even though he got a job two months after we moved in.





Most of the furniture is his, and I'm not trying to keep any of his things just the APARTMENT. He only has a part time job, I work 70-80 hours a week. I'm afraid that he wont be able to support himself and I don't want to leave him like that. I'm helping him buy a scooter (we made a contract stating that he will pay me in installments for it) because I feel it will help him to get to work and go to school, cause he's not doing anything, according to him he has no motivation, I'm just doing this to help him get his act together. Now that we've arranged this, he's been talking about how he's going to get a second job and pay all the bills and this and that, BUT I don't want to be with him anymore! When we first got the place he said if I would ask him to leave he would, since I paid for it. Now when we fight he says he'll fight for the place and get ME out. Last big argument we had he punched holes on a door because he knew I could loose my deposit. He's crazy like that and that is why I'm sick of him. Am I wrong for wanting to brake up with him and keep the place? He makes me have these guilt trips saying I'm the one who "wins at the end by putting him on the street"


I mean I work super hard for this place. Like I don't even have a life cause of this asshole he's always calling when I'm at work. I can't even visit a friend or family cause he's just CALLING and CALLING.





I don't even know how to bring it up to my landlord. Cause if I "get" the place I know I will be miserable the whole time he's there or he'll probably wreck the place just like he has threaten he will. I mean one time I woke him up by turning on the lights one time when I got home from work really late, I didn't mean to. But he ended up flipping out and made me stay up with him because he couldn't go back to sleep, but I mean like MADE ME stay up : sit on the floor, threatening me, pull me up by my shirt and yell at me if I dosed off (I had class and work the next day) I mean COMPLETE asshole!


I don't know what to do. I don't want to loose the place but I don't know how to go about this. Am I greedy? :( PLEASE help|||Laws on this vary by state, but generally if the person is on the lease they can't be forced out. If he's not on it the place is yours. He is abusive, and the next time he threatens you or damages the place or puts his hands on you, call the police as that is domestic abuse. Get rid of him ASAP he is dangerous.
