Ok my landlord is trying to evict me but doesn't really have a right expect for the fac that she dosn't like me! At first she loved me as a matter of fact this is why we are both in the situation we are in. I had to move out of my prior condo on the 15th of the month and was going to move into another condo on that same day. I had previously spoken to her about her condo but I knew it wouldn't be ready untill the 30th of the month, which wouldn't work so I had chossen to go to the other condo. She calls me begging me tto come and rent from her cause she really liked me! Feelings were very mutual and I wanted to rent with her. So stayed at someone elses house for 2 weeks and put my things in storage. Make a long story short, that someone stole my money order that i had for my security deposit and my 1st months rent from me ( I know who it was and I'm going through the courts to get it back) and so I called her asking her to hold the condo for me untill i was able to get the money up again ( which would take about 2 weeks). She and her husband both said that I could move in and pay them in the time frame I gave them , again, I NEVER ASKED HER FOR THIS.... SHE VOLUNTEERED. I was 4 days late on the day that I told her I would pay it and she came to my house ( didn't say she was coming , and according to my lease she must give me 24 hours) and tries to get the police to tell me to leave. Of course they tell her to go through the eviction process ( this was all on a wedensday). Ok so I get my 3 day notice on thurdays, no biggy to me because I know that on Friday I would be giving her more than what I owed her ( my rent is $1100.00 a month, I was giving her rent for April and for May so thats $2200).
Ok 1st problem:
The notice states I owe her $2200. HOW? I just moved in on March 30th and the day of the notice was the 15th! So I thought about it, maybe she wants the 1st month and security deposit. But then I looked at my lease and it clearly states A. I can pay my rent biweekly and B. my security desposit can be paid in 4 installments ( no time limit for the 4 installments, just says 4). So to sum it up I don't even owe her $2200.00 ( even tho I have it to pay)!
2nd problem is:
As I stated I already had the $2200.00 to pay for April and May and because she was nice enough to let me move in for NOTHING, I was just going to give it to her, but she will not answer the phone! I've called her soooooooooooo many times, left her messages and all and she will not call me back or answer!
So what do I do! Clearly the whole notice is not right, I don't owe her $2200.00 even if I paid my full rent for April and paid my security deposit in the 4 installments ( it had only been 2 weeks). She's not answering her phone, can I go to her house and try and make her take the rent?|||It's private property, so she can evict you if she wants. As long as you do not have a lease, she does not have to let you stay. She does not have to accept your rent. As long as you have not paid, she has the legal right to kick you out.
